Online Store Regulations

  1. General Provisions

These regulations define the rules for using the online store "Store Name" (hereinafter referred to as the "Store"), which is available at the website www.crea-shop.eu and run by Crea-Form Sp. z o.o. with its registered office in Włostów. The company is registered in the entrepreneurs' register by the District Court under the registration number KRS: 0000970605, and has a tax identification number (NIP) of 7861727167, and a National Business Registry Number (REGON) of 521961450 (hereinafter referred to as the "Seller").

The Store conducts retail sales of goods via the Internet in Poland and Europe. All goods offered in the Store are brand new, free from physical and legal defects, and have been legally introduced to the Polish market. The prices of all goods in the Store are given in Polish zlotys or in Euro currency (PLN) and include VAT tax.

To use the Store, the Client should create an account by providing personal data and accepting these regulations. It is also possible to make purchases without registration.

 

  1. Orders and Fulfillment

Orders can be placed using the form available on the Store's website 24 hours a day, 7 days a week. By placing an order, the Client declares that they have read and accept the provisions of these regulations.

The condition for order fulfillment is the correct completion of the order form and providing contact details, including an email address and phone number. The order will be fulfilled after confirming the availability of the product and receiving payment on the Seller's account (in the case of choosing payment by bank transfer or card).

The deadline for order fulfillment is from 1 to 14 business days from the moment of order confirmation by the Seller. Sales documents will be sent to the email address of the ordering party.

III. Payments

The Store offers the following payment methods: a) Payment by bank transfer to the Seller's bank account, b) Payment by payment card, c) Electronic payment through an online payment system, d) Cash on delivery (available only for shipments delivered within Poland).

  1. Delivery

Goods are delivered within Poland via courier companies. The cost of delivery depends on the delivery method chosen by the Client and the payment method.

  1. Complaints and Returns

The Client has the right to complain about the product in case of physical or legal defects. Complaints should be reported in writing to the store's email address: sklep@cea-shop.eu, providing contact details, order number, a description of the defect, and the Client's request (e.g. repair, replacement, price reduction, termination of the contract).

Complaints should be reported immediately after detecting the defect but no later than within 2 years from the date of issue of the goods. If the complaint is acknowledged, the Seller will fulfill the Client's request immediately, but no later than within 14 days from the date of reporting the complaint.

The Client has the right to withdraw from the distance contract within 14 days of receiving the goods without giving any reason. A statement of withdrawal from the contract should be sent to the store's email address: sklep@cea-shop.eu.

In case of withdrawal from the contract, the Client is obliged to return the goods at their own expense to the Seller's address immediately, but no later than within 14 days from the date of withdrawal from the contract.

The Seller will return all payments received, including delivery costs, immediately, but no later than within 14 days from the date of receiving the statement of withdrawal from the contract, using the same payment method that was used by the Client.

  1. Personal Data Protection

The Seller is the administrator of the Clients' personal data. Clients' personal data are processed solely for the purpose of fulfilling the sales contract and possible pursuit of claims related to the fulfillment of the contract.

The Client has the right to access their personal data, to correct, delete or limit processing, as well as the right to object to the processing of data and the right to data portability.

Detailed information on the processing of personal data by the Seller is included in the privacy policy available on the Store's website.

VII. Final Provisions

In matters not regulated by these regulations, Polish law shall apply, in particular the Civil Code and the Consumer Rights Act.

The Seller reserves the right to change these regulations. Changes are effective from the date of their publication on the Store's website. In the case of changes to the regulations, orders placed before the effective date of the new regulations will be processed based on the provisions applicable on the day the order was placed.

In case of disputes arising from the performance of sales contracts concluded through the Store, the parties will seek to resolve the dispute amicably. If this is not possible, the competent common court will settle the dispute in accordance with Polish law.

A consumer who is a Client has the possibility to use an out-of-court complaint and redress procedure before the Permanent Consumer Arbitration Court operating at the Provincial Inspectorate of Trade Inspection. Information on the procedure and the possibility of using out-of-court dispute resolution is available on the website of the Office of Competition and Consumer Protection (uokik.gov.pl).

A consumer who is a Client may also use the ODR (Online Dispute Resolution) platform available at http://ec.europa.eu/consumers/odr/ to resolve a dispute related to a sales contract concluded through the Store out of court.

VIII. GDPR - General Data Protection Regulation

In accordance with Article 13(1) and (2) of the General Data Protection Regulation of 27 April 2016 (GDPR), we inform that:

  1. a) The Administrator of Clients' personal data is Crea-Form Sp. z o.o. with its registered office in Włostów, registered in the Register of Entrepreneurs by the District Court under the number KRS: 0000970605, NIP: 7861727167, REGON: 521961450 (hereinafter referred to as the "Seller"). c) Clients' personal data is processed for the purpose of fulfilling the sales contract, based on Article 6(1)(b) of the GDPR, as well as for purposes resulting from the legitimate interests pursued by the Administrator, based on Article 6(1)(f) of the GDPR. d) Recipients of Clients' personal data may be entities providing services to the Administrator, such as IT system providers, courier companies, entities providing accounting, legal, marketing, and electronic payment services, as well as relevant public authorities if required by applicable law. e) Clients' personal data will be stored for the time necessary to fulfill the sales contract and for the period required by law, in particular by tax and accounting regulations. f) The Client has the right to access their personal data, to correct, delete, limit processing, the right to data portability, the right to object to the processing of data and the right to withdraw consent to the processing of data at any time, if the processing is based on consent. g) The Client has the right to lodge a complaint with the supervisory authority, i.e., the President of the Office for the Protection of Personal Data, if they believe that the processing of personal data violates the GDPR. h) Providing personal data is voluntary, but failure to provide data necessary to fulfill the sales contract will result in the inability to process the order.
